RESPONSIBILITY OF CONTROLLED DOG LICENSE

UNDANG-UNDANG KECIL PELESENAN ANJING DAN RUMAH PEMBIAKAN ANJING ( WPKL ) 1991 ( PINDAAN ) 2011

Under UUK 3(2) – one application for one license: (c) in the manner of controlled dogs, must be done after-

  • The applicant has followed and passed the course for the handling of dogs and
  • The dogs have followed and passed the course “Canine Good Citizen” which is launched by any organization authorized by the Mayor

Under UUK 8C, an individual who was granted a license to keep, breed, own and protect a controlled dog must:

  • The dogs owned must be under constant supervision at all times.
  • The dogs must always be on a leash and as its mouth covered whenever it leaves the premise.
  • Ensure the dogs does not leave its area designated area.
  • Ensure the premise is gated and safe and and that the gate is well maintained at all times.
  • Ensure a sign displaying “BEWARE OF DOG” is placed and that it is easily visible to the public.

Under UUK 2 ( c )-a supervised dog refers to any dog listed under schedule IV

  • Rottweiller
  • Doberman
  • German Shepard / Alsatian including Belgian Shepard dan East European Shepard
  • Bull Mastiff
  • Bull Terrier
  • Perro de Presa Canario ( also known as Canary Dog )

BAN TOWARDS PROHIBITED DOGS

Under UUK 8B (1) , nobody is permitted to keep, maintain, care or protect any breed of dogs that are prohibited.

Undang-undang kecil 2 (d) – prohibited breed of a dog is such as those stated under schedule III

  • Pit Bull Terrier / Pit Bull ( Also known as American Pit Bull , American Pit Bull , American Pit Bull Terrier, American Staffordshire Terrier and Stafford Bull Terrier )
  • American Bulldog
  • Neapolitan Mastiff
  • Japanese Tosa
  • Akita
  • Dogo Argentino
  • Fila Braziliero

Under UUK 8B (2) , the Mayor must seize and dispose of whichever prohibited breed of dog that is found at any premise or anywhere in public.

Under UUK 8B (3), there would be no reparation that is to be payed by the mayor for the disposal of these dogs.

KEEPING PET DOGS IN MULTI LEVEL BUILDING/HIGH RISE BUILDINGS (SUCH AS CONDOMINIUMS AND APARTMENTS)

Under the Undang-undang Kecil Perlesenan Anjing Dan Rumah Pembiakan Anjing ( Federal Territory Kuala Lumpur) (Pindaan) 2011 UUK8A “Small dogs in a flat” The Mayor may allow one small dog to be cared for, maintained and protected in a flat.

Under UUK 2 (b)- small dogs are referred to any breed listed in Schedule II:

  • Minature Pinscher
  • Bichon Frise
  • Pekingese
  • Papilon
  • Poodle (Toy)
  • Japanese Chin
  • Maltese
  • Pomeranian
  • Chihuahua

Under UUK 3(1)- Nobody is permitted to care for, keep, maintain or protect any dogs unless the dog has a license according to the ‘Undang-undang kecil’

Under UUK 3(2)- Only one application for one license:

i) Must got through the mayor in any shape or form which is to be decided by the mayor. ii) Must be followed by a fee of RM10

The application for the dog license must be followed by a letter of agreement from the Joint Body Management (JMB) or Management Corporation (MC) when applying.

Dogs that are care for must not act out/ cause disturbance or hassle to any nearby neighbors or other dog owners.

The disturbances are as stated:

  • The dogs cause damage to public properties or injury to any civilian or the residents of the building.
  • The dogs create a noisy environment (day and night) and disturbs the residents.
  • The dogs are roaming around without supervision.
  • The dogs are acting out in an aggressive manner that may cause danger/ is dangerous to others.
  • The dogs owned must be kept at its owner’s home and vicinity only.

The dog owners may only take the dogs out of the building using elevators and the dogs must be constantly supervised.

The dogs must not be allowed to urinate or defecate in public areas and if so, the owners must take responsibility to dispose of the dog droppings.

AKTA HAKMILIK STRATA 1985 ( AKTA 318 )

Based on 6(d) in the third schedule of Akta Hakmilik Strata 1985 (Act 318) describes that the owner of the area may not own any pets in his area if it were to cause annoyance to any other owner/residents.
